NYSED Substantial Equivalency Review Timeline

    2018-2019:      Attend training to learn about the New York State Substantial

                                 Equivalency Process

    May 2019:        NY State Supreme Court Justice suspends Substantial Equivalency


    June 2019:      Newly proposed regulations were sent to the

                                 New York State P-12 Education Committee for discussion at the

                                 June 2019 Board of Regents meeting.

    After publication of the proposed amendment in the State Register and expiration of the 60-day required public comment period, the Board of Regents may  adopt the regulations at its October 2019 meeting providing there are no material changes. The proposed amendment will be effective on October 23, 2019.

    2019-2020:     Continue Reviews 

    • NYSED recommends that new schools be reviewed within three years of operation and that existing schools be reviewed by the end of the 2022-23 school year 
    • NYSED requires LSAs' to annually file a list of nonpublic schools subject to their review and Commissioner’s Review by September 1, 2020 and each Sept. 1 thereafter                  


    All reviews must be complete by the end of the 2022-23 school year

    •  NYSED will require LSAs to file an annual update regarding the status of substantial equivalency reviews by Sep. 1, 2024 and each September 1 thereafter
